Terms and Condition

  1. GENERAL Privyer 1 is a service of Privyer 1 Corp. TNC, 2401 Collins ave Miami Beach 22140. These terms and conditions pertain to the agreement between Privyer 1 Transportation Network Company and anyone engaged in business with or related to our services, hereafter referred to as “The RIDER,” encompassing both potential and established customers. These terms and conditions are currently in effect and can be accessed on our website and application. Privyer 1 is a TNC luxury car service that offers a wider range of services compared to competitors like UBER and Lyft. Our drivers are self-employed and do not require, nor do we provide, full or temporary employment.
  1. START OF THE CONTRACT The contract begins when the rider submits a booking request by completing a reservation form and clicking the “Book Now” button, whether through the web or the app. Clients can make changes or corrections to their data using the “next” and “back” buttons before submission. Before proceeding with the booking, the client must acknowledge and accept the “Terms & Conditions.” An automated email confirming the request’s receipt will be sent, but this does not constitute automatic acceptance. A second email will be dispatched indicating the acceptance or rejection of the ongoing booking.
  2. CONTENT OF THE CONTRACT The initial prices displayed for one-way transfers from point A to point B include gratuity, taxes, and airport fees. Additional charges apply for extra services such as additional stops, baby car seats, extended time, dog service, meet and greet, etc. These additional services may incur extra fees. For services involving baby car seats, clients must specify the child’s age and the number of required seats in the “additional comments” box. Failure to provide this information may result in reservation cancellation with full fare charges. Occasionally, a complimentary “upgrade” from “Business Class” to “First Class” may be provided without prior notice. Certain unforeseen events, like adverse weather conditions, significant flight delays, or other circumstances leading to extended waiting times, may result in reservation cancellations, and clients must acknowledge and accept these conditions. The maximum vehicle capacity for passengers and baggage must be adhered to, considering passengers’ size and comfort when making the booking. Chauffeurs have the discretion to decline passengers if space and safety conditions are compromised. For hourly reservations, a minimum booking duration of 3 hours applies.
  3. PAYMENTS The price confirmed in the reservation includes all taxes and gratuities and is binding. The guaranteed reservation price is calculated based on the chosen vehicle type, distance, lead time, pickup time, and location. Additional requests like baby car seats or extra stops incur additional charges. Any spontaneous changes, such as alterations in distance or time, will result in price adjustments, billed every 30 minutes at the hourly rate in accordance with the current pricing structure. Cross-county travel during hourly bookings may involve extra charges. Privyer 1 operates as a cashless platform, allowing customers to pay with credit cards. A 2.5% processing fee is added when using a credit card.
  1. CANCELLATION POLICY For “RIDE LATER” transfers, cancellations made more than 90 minutes before the pickup time are not subject to charges. Cancellations made within 90 minutes or less will result in a 100% charge, including all applicable fares up to that point. In the case of “RIDE NOW” transfers, no cancellation fee applies if the cancellation is made before the driver accepts the booking and indicates being en route; a 50% cancellation fee applies thereafter. For hourly bookings, cancellations made more than 90 minutes before the pickup time are not subject to charges, while cancellations within 90 minutes or less will result in a 100% charge. A “No Show” without prior cancellation will incur a 100% charge. A “No Show” is defined as a passenger not appearing at the specified location and time as stated in the reservation for 45 minutes at airports or seaports, and 30 minutes at residences. Flight delays will not be considered. If a client anticipates a delay and calls the driver to request waiting beyond the allowed time, the driver cannot refuse, and the client will be charged for overtime, categorized as “waiting time,” and billed accordingly.
  1. BEHAVIOR IN THE VEHICLES Passengers are obliged to wear seat belts as per road safety regulations. Chauffeurs bear the responsibility for passenger safety and must be obeyed. It is prohibited to open vehicle doors while the vehicle is in motion, throw objects from the vehicle, or protrude body parts or make loud noises. Smoking and alcohol consumption are not permitted inside the vehicles.
  1. LIABILITY AND WARRANTY Privyer 1 is not responsible for errors on our website or application, including but not limited to inaccuracies, reliability issues, incompleteness, or damages resulting from service errors, delays, or interruptions, technical infrastructure issues, incorrect content, omissions, data loss or deletion, viruses, or any damages arising from the use of our online service. Privyer 1 is also not liable for the availability and functionality of offered features. Privyer 1 assumes no responsibility for third-party website content, correctness, legality, or any issues arising from linked websites. Privyer 1 shall not be held liable for communication network and gateway failures, power outages, or internet interruptions. Liability for services provided by Privyer 1, its affiliates, and drivers is excluded. In the event of liability, the maximum compensation will be limited to one time the fare of the ride. Clients must report any complaints to our office as soon as possible. Privyer 1 is not responsible for theft, loss, or damage to property carried in the vehicle. Complaints regarding such issues must be filed promptly and resolved within 30 days. Privyer 1 is liable only for intentional misconduct and gross negligence, unless it breaches a contractual obligation. For loss of profits, savings, incidental damages, and/or consequential damages, Privyer 1 is liable only for willful infringement. Except for willful infringement, Privyer 1’s liability is limited to damages reasonably foreseeable at the contract’s conclusion. Liability for injuries to life, limb, or death remains unaffected.
  2. OBLIGATIONS OF THE CLIENT Clients are responsible for ensuring that all information provided to Privyer 1 is complete and accurate. Any use of false, fraudulent, speculative, or similar information is prohibited, as are automated registration procedures. Clients confirm that transportation services will be used only for legal purposes. Clients are liable for any damages exceeding legal limits caused to the vehicle and the driver.
  3. DATA SECURITY, PERSONAL PROTECTION Privyer 1 places a high priority on privacy and personal data protection. Handling of personal data complies with legal requirements, and collected client information is stored with strict security protocols. Data is used solely for transportation services and is not shared with third parties except for name and phone number when an affiliate carries out the service on our behalf. Clients consent to data disclosure for contractual fulfillment. Credit card details entered during the initial reservation are securely stored, with access restricted to authorized personnel only.   4. CHANGE IN SERVICES : Privyer 1 reserves the right to temporarily or permanently suspend its services for significant reasons, even without prior notice. Privyer 1 operates as a transportation network company/car service, adhering to the requirements of the law. The independent drivers operate their own vehicles, either leased or owned, and are dispatched solely through the app.
